Terms of Service for Sports Capture Media Client Gallery

Welcome to Sports Capture Media’s Client Gallery. By accessing or using our client gallery services (the "Gallery"), you agree to comply with and be bound by these Terms of Service. Please read these terms carefully.

1. Ownership of Content

All images, videos, and other media (collectively, "Content") displayed in the Gallery are the intellectual property of Sports Capture Media. These materials are protected by copyright laws and are provided solely for personal, non-commercial use by the client.

  • You may not reproduce, distribute, modify, or create derivative works from the Content without prior written consent.

  • Watermarked images in the Gallery may not be altered or used without purchase and express permission.

2. License for Purchased Content

Upon purchasing digital downloads, prints, or other products:

  • You are granted a non-exclusive, non-transferable license for personal use.

  • Commercial use, redistribution, or resale of the Content is strictly prohibited unless explicitly agreed upon in writing.

3. Gallery Access

  • Access to the Gallery is provided to clients via a secure link or login credentials.

  • Sharing Gallery access with third parties is not permitted unless approved by Sports Capture Media.

  • Sports Capture Media reserves the right to revoke access to the Gallery at any time without prior notice, particularly if misuse is detected.

4. Limitation of Liability

Sports Capture Media makes no guarantees regarding:

  • The uninterrupted availability of the Gallery.

  • The accuracy or completeness of the Content displayed in the Gallery.

To the fullest extent permitted by law, Sports Capture Media is not liable for any direct, indirect, incidental, or consequential damages arising from:

  • Unauthorized access to your Gallery.

  • Loss or corruption of digital files.

5. Image Retention Policy

  • Client Galleries will remain accessible for a period of 60 days from the date of delivery unless otherwise agreed upon in writing.

  • After this period, the Gallery may be removed, and it is the client’s responsibility to download purchased images during the retention period.

6. No Refund Policy

Due to the nature of digital and customized products:

  • All sales are final once a digital download or print order is fulfilled.

  • Refunds or exchanges are not available unless a technical issue or error caused by Sports Capture Media is identified.

7. Privacy

Sports Capture Media respects your privacy and will not share your personal information or images publicly without prior consent. However, you acknowledge that images may be used for promotional purposes if agreed upon in your contract.

8. Prohibited Use

Clients may not:

  • Use images for defamatory, unlawful, or obscene purposes.

  • Remove watermarks without proper authorization or payment.

9. Indemnification

You agree to indemnify and hold harmless Sports Capture Media from any claims, liabilities, damages, or expenses arising from your misuse of the Gallery or Content.
